Employment Tribunal claims

Advice and representation in Employment Tribunals for claims of unfair or wrongful dismissal across all sectors.


Initial consultation

We offer a fixed fee of £150 plus VAT for an initial consultation.  This includes meeting with the client, going through the papers and confirming the advice in a letter.  We expect this to be around one hour’s advice.


Simple case

We anticipate in a simple matter; our fees will include:-

Defending or bringing a claim in the Employment Tribunal for Unfair Dismissal:-

  • Responding to or filing the claim
  • Following the Tribunal directions
  • Arranging representation for you at a One Day Hearing

Our hourly rate is £225 plus VAT, per hour, taking into account a range of approximately 15- 20 hours of work, amounting to total fees of between £4,050 – £5,400.00 plus VAT.


Disbursements

Barristers fees estimated at £1,500 – £2,500 (plus VAT) for representation at one/two-day hearing.

This would include the following:-

  • Meeting with you and taking your instructions, to either prepare your Statement of Claim or reviewing the ET1 and statement of claim you have received and your documents and providing initial advice
  • Drafting a Response form (ET3) for you and a Response and lodging this electronically
  • Receiving the Tribunal’s order giving directions for the steps to get to the hearing
  • Drafting and exchanging Lists of Documents and considering all documents. Preparing witness statements
  • Reading and advising on the witness statements
  • Drafting a Chronology for the Hearing
  • Preparing the Hearing bundle (if required)
  • Booking and briefing a barrister to represent you at the Hearing
  • Correspondence/emails/telephone calls necessary to progress the above


In a Complex case

We anticipate our fees will include:

Defending or bringing a claim in the Employment Tribunal for Unfair Dismissal:-

  • Responding to or filing the claim
  • Following the Tribunal directions
  • Arranging representation for you the Hearing – 2 – 5 days

Our hourly rate is £225 plus VAT, per hour, taking into account a range of approximately 38 – 80 hours of work, amounting to total fees of between £10,260.00 – £21,600.00 plus VAT.  The complexities of the case will determine the number of hours spent on the case and whether the case falls on the low end or high end of the above fees.


Disbursements

Barristers fees estimated at £1,500 – £2,500 plus VAT for representation at one/two-day hearing. 

Barristers fees estimated at £3,000 – £7,000 plus VAT for 2 – 5-day hearing.

This would include the following:-

  • Meeting with you, taking your instructions and reviewing documents in support of your claim or defence and providing initial advice
  • Drafting a claim form (ET1) for you and Particulars of your Claim and lodging this electronically or preparing form (ET3) and your Defence.
  • Receiving the Respondent’s Response (ET3).
  • The Tribunal ordering a Preliminary Hearing (up to half a day) to consider the issues and set a directions timetable, completing an Agenda and/or Statement of Issues for the Hearing and representation at the Hearing
  • Drafting and exchanging Lists of Documents and considering all documents
  • Preparing up to five witness statements
  • Reading and advising on the other sides witness statements – up to five witness statements
  • Drafting a Chronology/List of Issues/Cast List for the Hearing
  • Preparing the Hearing bundle
  • Booking and briefing a barrister to represent you for a Hearing lasting 2–5 days
  • Representation at the Hearing
  • Correspondence/emails/telephone calls necessary to progress the above

Additional charges will apply in the following circumstances:-

  • Additional preliminary hearings.
  • Remedy hearing (to calculate compensation) being held separately.
