Discrimination in the Workplace

There are various laws in place to protect people from being discriminated against in the workplace, and which give them rights to take legal action if they are mistreated due to their race, sexual orientation, age or gender.

Types of workplace discrimination

It is illegal for anyone to be discriminated against in the workplace due to their:

  • Race
  • Gender
  • Sexual orientation
  • Religious or political beliefs
  • Disability

It is also illegal for employees to be treated differently or unfairly because they are transgender, are pregnant or have children, are married, or have entered a civil partnership.

Discrimination can be direct or indirect. Direct discrimination refers to the time before a job is taken and an example could be an applicant being rejected for a role due to a disability.

Indirect discrimination involves certain conditions being imposed on an entire workplace but which have a negative impact on a certain individual or individuals – for instance if working hours were suddenly extended making it impossible for a working parent to balance taking their child to school and arriving at work on time.
