Legal Advice: Maternity & Paternity Pay & Leave

All pregnant women who are employed are entitled to a full year of maternity leave, which is split into two 26 week blocks of ordinary maternity leave and additional leave. During this time you may be eligible for maternity pay, or paid time off for antenatal care.

New fathers are entitled to up to two weeks of paid paternity leave, and under certain circumstances can request an additional 26 weeks of paid leave – usually this is only if the mother has returned to work.

You are legally entitled to these rights and if your employer has withheld pay during your maternity leave, or your partner’s employer has refused paternity leave they are breaking the law and you may be able to make a claim for compensation.

Maternity leave UK law explained

Under maternity leave law you do not have to take the full 52 week entitlement but you must take two weeks’ leave – this rises to a month if you work in a factory or have a manual job.

The earliest your maternity leave can start is 11 weeks before your due date. If you want to change the date which you return to work then you must give your employer at least eight weeks’ notice.

Statutory maternity pay is worked out as 90 per cent of your average weekly earnings before tax for the first six weeks of leave, and whichever is lower out of £136.78 or 90 per cent of your earnings for the following 33 weeks.

Advice about maternity and paternity leave

If your employer has restricted or denied your legal rights to maternity leave and pay, or your partner has recently given birth and your employer is not granting you the paternity rights you are entitled to, you may be able to make a claim.
