Slip, trip or fall on public highway? 

The local authority has a legal duty to ensure that public highways are regularly inspected and properly maintained to prevent dangerous defects occurring.  

Slip, trip or fall at work? 

Your employer has a legal duty to ensure that your workplace is safe and free from obstructions and tripping hazards.  

If you are injured in a trip, slip or fall accident, which was caused by the fault of someone else, you will be entitled to compensation for the injuries and financial losses you have sustained as a result. 

What to do if you are involved in a slip, trip or fall 

  • Report the accident to the premises’ owner, staff member or supervisor immediately.  If you are involved in an accident on public highway, report the accident to the local highways authority as soon as you can afterwards
  • If you are able to, take the details of any witnesses to the accident
  • If you are able to, try to take a photograph of the accident location.  If your accident was caused by a poorly maintained pavement, it is advisable to photograph a ruler beside the defect to give an idea of depth/height
  • Seek medical attention from the hospital or your GP - it is important you have a full record of your injuries in your medical records
  • Keep a diary of all of the symptoms of your injuries
  • Keep a record (as well as any receipts) of any expenses you incur as a result of the accident - loss of earnings, medical expenses, travel expenses all form part of your compensation
