70-year-old Terry Brazier of Hinckley, Leicestershire, contacted his local law firm Bray & Bray Solicitors after being given the wrong medical procedure at Leicester Royal Infirmary. With the help of our specialist personal injury team, he received £20k in compensation.

Mr Brazier was supposed to receive a cystoscopy, a procedure that involves looking inside the bladder using a thin camera before Botox is injected into the bladder wall, but was instead mistakenly circumcised in what has been recorded as a ‘never event’ by the hospital.

According to the National Quality Forum (NQF), ‘Never Events’ are errors in medical care that are clearly identifiable, preventable, and serious in their consequences for patients.

Following his operation, Mr Brazier was told that he had received the wrong procedure. It transpired that a late change in the operating theatre list schedule due to one patient’s test results not being ready did not result in the corresponding change in the surgery to be performed, so Mr Brazier had the circumcision another patient on the list was scheduled for.

Claim for compensation

Mr Brazier decided to take legal action after the hospital admitted that the necessary checks had not been carried out before the procedure took place. He got in touch with Ian Johnson, Partner and Head of the Personal Injury and Clinical Negligence Department at Bray & Bray, who was able to provide specialist advice on the appropriate course of action in making a claim for compensation. Ian worked with Charlotte Gurney, Associate Personal Injury Solicitor at Bray & Bray, to assist Mr Brazier in negotiating a £20,000 payment.

Ian commented: “This was certainly a shocking case which NHS Trusts call a ‘Never Event’ as it should never be possible for it to happen. We were consulted by Mr Brazier following his ordeal and after writing to the NHS Trust, they quickly admitted fault and made an offer of compensation. We were eventually able to negotiate an increase in the initial offer up to £20,000, which Mr Brazier was happy to accept.”
